A woman who filed criminal charges against the Mayor of Ohioville after she was allegedly attacked by the man has died, according to members of her family.
Theresa Tice, daughter of Mayor John Szatkiewicz’s live-in girlfriend Linda Tice, died yesterday following several emergency surgeries for a medical condition. Law enforcement sources do not believe her death is in any way related to the alleged attack.
Mayor Szatkiewicz was charged on August 7th with harassment, disorderly conduct, simple assault, and obstruction of an emergency call after Ohioville Police say he assaulted Tice during a domestic disturbance. Officers allege Szatkiewicz beat the woman’s head on a doorjamb several times before placing one of his hands around her throat and another over her mouth and nose while telling her, “This is how I was trained to kill people.”
Magisterial District Judge James DiBenedetto dismissed charges against Szatkiewicz on Wednesday, after declining a request by prosecutors to continue the preliminary hearing in the case. Judge DiBenedetto denied the request because police failed to provide proof that Tice was undergoing emergency surgery at the time.
A previous request for continuance in the case made by Myron Sainovich, Szatkiewicz’s defense attorney, was granted on August 15th.
District Attorney Anthony Berosh issued a letter to Ohioville Police following the dismissal, instructing officers to refile the case against Mayor Szatkiewicz. Charges had not been refiled prior to Tice’s death, and it remains unclear if the District Attorney’s Office will be able to continue prosecuting the case.
